Policy Scope: This AUP applies to all Cloud Cubix services. Use of Services constitutes agreement to comply with all local, state, and international laws.
I. VoIP & Messaging Specific Prohibitions
- Illegal Robocalling & SPIT: Unsolicited bulk voice messaging, Spam over Internet Telephony (SPIT), or telemarketing violating "Do Not Call" registries is strictly prohibited.
- Toll Fraud Prevention: Any effort to circumvent billing, hack accounts for long-distance calls, or engage in traffic pumping is grounds for immediate termination.
- SMS Compliance & Opt-Out: All messaging must comply with 10DLC regulations, including mandatory "STOP" opt-out mechanisms. Aggressive "blasting" that triggers carrier-level filtering is a violation.
- E911 Requirement: Users **must** maintain an accurate physical address. VoIP E911 does not automatically update; failure to provide accurate data may result in emergency routing failures.
II. Web Hosting & Content Restrictions
- Malicious Content & Brand Impersonation: Storage or publication of viruses, Trojans, malware, or phishing environments is prohibited. This explicitly includes hosting brand-spoofing landing pages, credential harvesting forms, or deceptive configurations designed for social engineering schemes.
- Cryptocurrency Mining: Utilizing shared web hosting, reseller architectures, or VPS virtual server environments for cryptocurrency mining (including background scripts, farming, or daemon deployment) is strictly forbidden due to severe resource degradation. Unauthorized execution results in immediate process termination and suspension.
- Illegal Material: We do not host pornography, hate speech, or unlicensed copyrighted materials (Warez/Torrents).
- High-Risk Services: Hosting of IRC servers, Tor Exit Nodes, or public Proxy/VPN services is prohibited due to high DDoS risk and network abuse potential.
- Email Spamming: Sending unsolicited email (SPAM), mail bombing, or distributing fraudulent/harassing messages will result in immediate suspension.
III. Security, Network Integrity & Spoofing
- Account Security: Users are mandated to maintain complex passwords and keep credentials confidential. You are responsible for all activity originating from your account.
- Network Misuse & IP Spoofing: Unauthorized access (hacking), port scanning, or "Denial of Service" (DoS) attacks initiated from our network are strictly forbidden. Forging packet headers, spoofing IP source details, broadcasting unassigned MAC data, or generating malicious network routing table anomalies is strictly prohibited.
- Automated Monitoring: Cloud Cubix utilizes automated security systems to monitor for malicious patterns (malware, brute force, VoIP fraud). This monitoring is a condition of service.
IV. Domain Registrations & Use
Violations of these terms will result in immediate domain cancellation without refund.
- Trademark Infringement: Registration of domain names for "cybersquatting" or infringing upon established trademarks is prohibited.
- ICANN Compliance: All registrants must comply with the ICANN Registration Data Policy. False WHOIS information is grounds for deactivation.
V. Children’s Online Privacy Protection Act (COPPA)
Age Restriction: Cloud Cubix services are intended strictly for business use. We do not knowingly collect information from children under the age of 13. If you are under 18, you may not use these services.
VI. Infrastructure, IP Reputation & Data
- IP Blacklisting: If your activity results in the blacklisting of a Cloud Cubix IP address (Spamhaus, Barracuda, etc.), your account will be terminated without refund. You may be held liable for fees incurred to delist the IP.
- DDoS Provocation: We reserve the right to terminate any account that is a frequent target of DDoS attacks which disrupt service for other customers.
- Data Access Post-Violation: Upon termination for an AUP violation, Cloud Cubix is under no obligation to provide backups or access to data. Content will be purged immediately.
⚖️ Enforcement & Legal Cooperation
Authorities: Cloud Cubix LLC will cooperate fully with law enforcement and will provide information, including logs and user data, in response to valid subpoenas and court orders.
Violations: Violations of this policy result in immediate suspension or permanent termination of services without refund, at the sole discretion of Cloud Cubix.
VII. Reporting Abuse
To report malicious activity (spam, phishing, hacking, or VoIP abuse), please submit evidence logs and timestamps to our compliance team.
